ANKLE GmbH (“ANKLE”, “we”, “us”, “our”) operates this website and online store, including all related content, features, products and services (collectively, the “Services”). Our Services are powered by Shopify.

This Privacy Policy explains how we collect, use, process and disclose your personal information when you visit our website, purchase products, create an account, subscribe to our newsletter, contact us or otherwise interact with our Services.

ANKLE GmbH processes personal data in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679 – “GDPR”), the Austrian Data Protection Act (Datenschutzgesetz – DSG), and other applicable data protection laws.

For the purposes of the GDPR, ANKLE GmbH is the controller of your personal data.

Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. • Contact details including your name, address, billing address, shipping address, phone number, and email address.
• Account information including your username, password, saved addresses, security questions, account preferences and settings.
• Payment information including credit card, debit card, and financial account numbers, payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details. ANKLE does not store complete payment card details; these are processed directly by our payment providers.
• Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions.
• Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry.
• Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
• Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.

We may collect personal information from the following sources:

• Directly from you including when you create an account, visit or use the Services, communicate with us, or otherwise provide us with your personal information;
• Automatically through the Services including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies;
• From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;

4. How We Use Your Information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. We work with the following categories of service providers, who process personal information on our behalf or, in some cases, as independent controllers.

Shopify

Our online store is powered by Shopify, which provides the technical infrastructure for our store, including website hosting, checkout services, customer accounts, payment processing and security services. Information submitted through our website may be processed by Shopify and its service providers, which may be located outside the country in which you reside.

Payments

Payments may be processed through Shopify Payments, PayPal, Klarna, Apple Pay, and other credit card providers. Each payment provider processes your payment information under its own responsibility as an independent controller, subject to its own privacy policy.

Newsletter and Marketing Automation

We use Klaviyo for newsletter distribution and marketing automation. We may process your e-mail address, newsletter preferences, interaction data, open rates and click rates. You may unsubscribe at any time using the link provided in our marketing emails.

Google Analytics 4

We use Google Analytics 4 to understand how visitors use our website. Information processed may include your IP address, browser information, device information and interactions with our website.

Microsoft Clarity

We use Microsoft Clarity to understand how visitors use our website, through heatmaps and session recordings. Clarity runs only after you accept analytics cookies. Information processed may include your IP address, browser information, device information, clicks, scrolling and mouse movements. Sensitive information you type into forms is masked before it is recorded.

Google Ads

We use Google Ads and conversion tracking to measure advertising effectiveness, optimize campaigns and improve marketing performance.

Social Media

We maintain social media accounts, including on Instagram. If you interact with our social media channels, the privacy policy of the respective platform applies in addition to this Privacy Policy.

7. Disclosure of Personal Information

We do not sell your personal information. In certain circumstances, we disclose personal information to third parties for the purposes described below, subject to this Privacy Policy.

Service Providers

We share personal information with Shopify and the other vendors and service providers listed in Section 6 above, who process personal information on our behalf to provide the Services (e.g. hosting, payment processing, customer support, order fulfilment, analytics).

Marketing and Advertising Partners

Shopify offers optional features (such as Shopify Audiences) that can use data from your interactions with our store, together with data from other Shopify merchants, to help us and our advertising partners show more relevant advertising. We only use such features, and only share personal information with advertising partners for this purpose, where you have given your consent via our cookie banner. You can withdraw your consent at any time through our cookie settings, which will stop this sharing going forward.

We are currently reviewing whether these Shopify features are active on our store; if you would like to confirm your current settings or opt out in the meantime, please contact us at info@ankle.cc.

Disclosures at Your Direction

We may disclose personal information to third parties where you direct or request us to do so, or otherwise consent to such disclosure — for example, to ship your order, or through your use of social media widgets or login integrations.

Affiliates and Corporate Group

We may share personal information with our affiliates or otherwise within the ANKLE corporate group, where applicable, for the purposes described in this Privacy Policy.

We may disclose personal information in connection with a business transaction, such as a merger, acquisition or insolvency proceeding, to comply with applicable legal obligations (including responding to subpoenas, court orders or similar requests from public authorities), to enforce our Terms of Service or other policies, and to protect the rights, property or safety of ANKLE, our users, or others.

8. Customer Accounts

You may create a customer account. Customer accounts allow you to access your order history, save addresses, manage preferences and speed up future purchases. You may delete your account at any time by contacting us.

9. Marketing Communications and Your Choices

We may send you promotional emails; you may opt out at any time using the unsubscribe link included in those emails. If you opt out of marketing emails, we may still send you non-promotional communications, such as those relating to your account or orders.

10. Do Not Track and Global Privacy Control

If you visit our website with the Global Privacy Control (GPC) opt-out signal enabled, we will, where applicable, treat this as a request to opt out of non-essential cookies and related processing for the browser and device used to visit our website. To learn more about GPC, visit https://globalprivacycontrol.org/. Other than GPC, we currently do not respond to “Do Not Track” signals that may be sent by your browser or device.

11. Children's Data

Our Services are not directed at children and are not intended to be used by children. We do not knowingly collect personal information from children below the applicable age of digital consent in their jurisdiction (in Austria, generally 14 years of age). If you are the parent or guardian of a child who has provided us with personal information, please contact us using the details below to request its deletion.

12. International Data Transfers

Some of our service providers may process personal information outside the European Economic Area (EEA). Where this occurs, we rely on appropriate safeguards, such as an adequacy decision by the European Commission, Standard Contractual Clauses, or other safeguards recognized under the GDPR.

We retain personal information only for as long as necessary, taking into account contractual obligations, legal requirements, tax and accounting regulations, and our legitimate business interests. Certain records, such as invoices, may be retained for up to seven years as required by Austrian law.

However, no transmission or storage system can guarantee absolute security, and any information you send us may not be secure in transit. Please avoid sending sensitive or confidential information through unsecured channels.

You may exercise any of these rights by contacting us at info@ankle.cc. We may need to verify your identity before processing your request, as permitted or required by applicable law. You may also designate an authorized agent to submit a request on your behalf; we will require proof of the agent’s authorization and may still require you to verify your identity directly with us. We will not discriminate against you for exercising any of your rights, and we will respond to your request within the timeframes required by applicable law.
